Interest accrued without notice has been refunded

After the KDK decision, the doctor, who resigned from the contractual chief medical position and began working as a permanent employee in the state hospital, was asked to reimburse the prepaid salary.

When the official letter was sent, the doctor was not informed that he would make payment on the same day.

After a while, the debt notification letter was sent via WhatsApp to the doctor, who called the trustees at the hospital and the provincial health directorate to inquire about the status of the notification.

The doctor, who was charged additional interest despite having made the payment on the day he found out about the debt, applied to the KDK for reimbursement of the wrongly paid interest.

KDK recognized the applicant's right and recommended that the Ministry of Health refund the amount of interest charged upon repayment.

In addition, it was requested that administrative measures be taken to inform reporting services personnel about compliance with the law, due diligence and duty of care, to ensure uniformity in practice and to carry out the service more carefully, attentively and in a timely manner.

Following the KDK's recommendation, the interest amount collected from the applicant was refunded.

The report must be made in accordance with the procedure

The decision emphasized that in order to charge interest on a claim, administrations must first send a proper notice to the debtor and give him a reasonable period of time for payment.

The decision noted that the consequences resulting from a lack of internal administrative coordination or delays in the reporting procedure cannot be blamed on citizens and made the following findings:

“In view of the fact that the administration did not properly remind the claim and the applicant did not default on the payment on the day on which he learned of the administration's reminder externally through the WhatsApp application, it was concluded that the statutory interest amount that the administration wrongly and unfoundedly accrued on the actual claim should be refunded to the applicant.”
