The “Regulation amending the Road Traffic Regulations” drawn up by the Ministry of Transport and Infrastructure came into force after publication in the Official Journal.
In his written statement on the regulation, Minister Abdulkadir Uraloğlu stated that comprehensive changes were made in line with industry needs, digitalization goals and operational efficiency.
Stating that the regulations issued will increase the quality of service in road transport and strengthen the unity of practice in the industry, Uraloğlu emphasized that they have ushered in a new era in road transport that will more strongly protect citizens' rights, respond more quickly to the needs of the industry and focus on digitalization.
Uraloğlu explained that in order to prevent airlines from being affected by terminal congestion, they have created the legal infrastructure to use the areas assigned or specified by local authorities when there is a lack of space in the terminals. Uraloğlu mentioned that regulations for the transportation of seasonal agricultural workers have also been implemented, pointing out that D3 permit certificate holders are only allowed to transport seasonal agricultural workers who work in their own agricultural areas.
New obligations for courier transport
Uraloğlu emphasized that they have taken steps to accelerate digital transformation in road transportation and announced that they have made the National Electronic Notification System (UETS) mandatory for all authorization certificate holders and that they will put the UETS requirement into effect from January 1, 2027.
Providing information about the required experience requirements in international logistics management, Uraloğlu said: “The previous validity periods of the approval documents, which form the basis of the three-year experience requirement for those who will carry out activities in international logistics management, are also included in the calculation.” he said.
Uraloğlu stated that the deadline for meeting professional qualification requirements in authorization certificate transfer procedures has been extended from 45 days to 60 days.
Stating that new obligations have been introduced in courier transportation, Uraloğlu emphasized that it has become mandatory for freight forwarders with a cargo transportation permit certificate to act in accordance with their courier obligations when carrying courier shipments. Uraloğlu pointed out that obtaining SRC courier and courier service documents was possible until January 1, 2027, and also stated that an extension was provided for the addition of B2 and D2 documents for 2013 model vehicles and earlier.
“Issuing an open ticket will be mandatory”
Pointing out the regulations on passenger rights, Uraloğlu said: “In order to prevent our citizens from suffering, we have made full reimbursement mandatory for intercity buses up to 12 hours before the departure time and if necessary within 10 days.
Stating that the age limits for drivers are left to the general legal provisions, Uraloğlu emphasized that vehicles are not allowed to go abroad without inspection for road safety reasons, even if they are registered in the registration certificate.
Uraloğlu pointed out that a maximum limit of 1 pickup truck was introduced when transporting household goods for those who only want to transport with a pickup truck.
Stating that new regulations have been issued for the use of motor vehicles in passenger transportation for tourism purposes, Uraloğlu stated that an incentive mechanism has been put into effect regarding the number of vehicles that can be used, with preference given to motor vehicles with a domestic goods certificate.
“We implement the graduated punishment system”
Uraloğlu also stated that the data transmission requirement of the Transportation Electronic Tracking and Control System (U-ETDS) has been abolished for D4 approval certificates whose departure or destination point is a metropolis and which have scheduled services.
Stating that D2 certified transport companies that transport disabled people and dialysis patients with a single vehicle are exempt from the professional qualification requirement, Uraloğlu stated that the ODY-ÜDY (Mid-Level-Senior Manager) requirement is not necessary for transport companies that do not have the ability to actually carry out transportation.
Stating that penalties were also imposed on airlines operating outside the scope, Uraloğlu said:
“In order to prevent illegal and unregistered transportation, we are introducing a gradual penalty system. Accordingly, an administrative penalty of 21,333 lira will be imposed for the first violation, 42,666 lira for the second violation, 106,665 lira for the third violation and 213,330 lira for the fourth violation.”
