A 14-day right of withdrawal has been introduced for new product purchases

The “Regulation on Refurbished Products” prepared by the Ministry was published in the Official Gazette.

The regulation regulated the implementation procedures and principles for the resale of used goods in a refurbished condition.

The ministry's statement on the regulation in question states that new regulations have been introduced to increase the effectiveness of the renewed product ecosystem, which ensures that technical products that must be purchased on the second-hand market are renewed within certain standards and offered for sale again with a guarantee.

The statement said the regulations aim to make the processes of reintroducing used technology products, from mobile phones to computers and smartwatches to gaming consoles, into the economy faster, more transparent and safer through guaranteed renewal.

The statement noted that the right of withdrawal was introduced for products purchased both online and in stores, saying: “With the new regulation, not only when purchasing online, but also for renewed products purchased physically in stores, consumers have the right to withdraw from the contract within 14 days without giving any reason.” Expressions were used.

The digital register entry is created with YÜBİS

The statement stated that a digital registration record with the Renewed Product Information System (YÜBİS) will be created for each device and will be made accessible, which parts have been replaced and which operations have been carried out, and the following statements were made:

“Lost, smuggled and stolen product inquiry records, information about the respective renewal center and all companies operating on behalf of these centers, as well as product certificates accessible through YÜBİS will be made available to consumers. In the current regulation, mobile phones, tablets, smart watches, game consoles and modems have been included in the renewal scope. With the new regulation, televisions are also included in the renewal scope and consumer insurance is expanded to a wider range of products. The minimum capital requirement for renewal centers was increased from 30 million “Administrative sanctions will be imposed on companies that violate the provisions of the regulation.” Authorization certificates of centers that affect the health, safety or economic interests of the consumer may be suspended or canceled by the Commission established. Renewal centers whose certificates have been canceled will not receive a new certificate for one year.

The statement recalled that an installment payment benefit has been introduced for refurbished mobile phones and the VAT rate for refurbished mobile phones sold by renewal centers and their authorized dealers has been reduced to 1 percent.

The statement says that the regulation will help prevent abuses that may occur in these applications and that electronic verification, recording and control mechanisms have been developed in this direction.

To date, 1.6 million products have been renewed

The statement noted that to date, approximately 1.6 million products have been renewed and relaunched, noting the following:

“The system in question is known to contribute to the country's economy by reducing e-waste, strengthening the circular economy and preventing waste and environmental damage. It is expected that the positive impact of the ecosystem will continue to increase with the new regulations. With this regulation, the ministry aims to promote both environmentally friendly and sustainable consumption habits and create a safe shopping environment by preventing consumers from falling victim to the second-hand market.”

On the other hand, the regulation comes into force on August 1st.
