The statement made on the Competition Authority's website said that in accordance with the Competition Authority's decision, the investigation into the allegation that companies operating in the field of tire production and distribution in the automotive industry violated the relevant article of the Law on Protection of Competition has been completed.
The statement said that the investigation examined allegations of concerted action between competitors in relation to price movements, exchange of competitively sensitive information, setting of dealer resale prices, regional and customer restrictions on dealers, discrimination, non-competition clauses, exchange of information that restricts competition in labor markets and does not mislead employees. As a result of the investigation, the following information was provided in the statement:
“Administrative penalties were imposed on Aydın Tire Sales and Service Services Ltd. Co., Modu Lastik Otomotiv Trade Inc., Cengizler Oto Lastik Pazarlama İnşaat Turizm Nakliyat Tekstil Emlak İthalat ve İhracat Sanayi Ticaret Ltd. Şti. and Gürlas Oto Lastik San. Tic. Ltd. Şti. Cengizler Oto imposed Lastik Pazarlama İnşaat Turizm Nakliyat Tekstil Emlak İthalat ve İhracat Sanayi Ticaret Ltd. Due to the violations identified during the investigation, administrative penalties were imposed on the companies in the amount of 497 million 91 thousand 986 lira as a result of reconciliation and 3 billion 136 million 843 thousand 185 lira as a result of the investigation, for a total of 3 billion 633 million 935 thousand 171 lira.
The statement stated that Prometeon Turkey Industrial and Commercial Tires, Brisa Bridgestone Sabancı Lastik Sanayi ve Ticaret and Hankook Tires would not be subject to fines and that it was decided that Brisa Bridgestone Sabancı Lastik Sanayi ve Ticaret AŞ would benefit from the block exemption under the block exemption communiqué on vertical agreements in the motor vehicle sector.
Restricting the indirect exchange of information via dealer channels
The statement states that commitments have been made to the investigated manufacturers and suppliers operating in the tire resurfacing market in Turkey to prevent the indirect exchange of information about traders who are believed to have an influence on the implementation of the identified concerted action regarding price movements, to prevent the repetition of the infringement in question and to create competition in the relevant market.
“A coding that distinguishes each dealer will be included in all announcements regarding the price list and price-related items to be made to the dealers, with a distinctive, visible watermarking process spread over more than one page.
No oral or written methods other than the appropriate interface and portal will be used. If such an interface and portal does not currently exist, this system will be created and made available to retailers. “Dealers are prevented from distributing information and announcements regarding prices and price components with future or future implementation dates to competing manufacturers or dealers.”
