The regulation to prevent arbitrary changes in land use is in force.

The “Regulation on the Implementation of Value Increase Shares in Changes to the Development Plan” drawn up by the Ministry of Environment, Urbanization and Climate Change was published in the Official Gazette and came into force.

According to the ministry's statement, with the amendment under Law No. 7534, previously published in the Official Gazette, it became mandatory to collect an “appreciation share” from the properties whose value increased as a result of the plan change.

While the new regulation aims to prevent unplanned urban growth and arbitrary zoning changes, 90 percent of the value created will be transferred to the public. The relevant increase in value is exclusively the increase in value of the property.

Citizens are also offered easy payment

On the other hand, citizens are also offered easy payment. Anyone who wants to pay for the increase in value in advance will receive a 10 percent discount. Property owners who wish to do so can pay in installments.

As part of the new regulation, a solution was also created for properties that were privately owned and were previously planned as public service areas such as authorities, administrative facilities, schools, health facilities, but could not be expropriated.

In this context, if public institutions no longer need these areas and the responsible administration agrees, a change in the plan can be made, thereby lifting ownership restrictions and preventing victimization of citizens.

On the other hand, disputes between the public and property owners are resolved without resorting to court proceedings.

With this regulation, the ministry aims to increase social benefits by ensuring the planned development of cities while preserving the share that is due to the public.
